India’s vehicle-tracking mandate has existed on paper since 2016. On 13 May 2026 the Supreme Court made it real.
On 13 May 2026, a bench of Justices J B Pardiwala and K V Viswanathan, deciding S. Rajaseekaran v. Union of India, recorded that fewer than 1% of transport vehicles on Indian roads actually carry a working Vehicle Location Tracking Device (VLTD). The Court directed every State and Union Territory to enforce the rule — and, critically, attached a consequence that fleet operators cannot route around.
What the Court actually ordered
The directions are administrative rather than penal, which is what makes them bite:
- No fitness certificate, no permit. Authorities were told not to issue fitness certificates under Section 56 or permits under Section 66 of the Motor Vehicles Act unless a VLTD and emergency button are installed and recorded in the VAHAN database.
- VAHAN integration is mandatory. States must integrate VLTD installation and functionality with VAHAN so compliance can be monitored in real time. A device that is fitted but not reflected on the portal does not count.
- Retrofitting is explicit. Para 16.3 of the order directs States and UTs to retrofit VLTDs and panic buttons in public service vehicles registered up to 31 December 2018 — this is not a new-vehicles-only rule.
For an operator, the practical effect is that a non-compliant vehicle stops being a compliance risk and becomes an un-permittable vehicle. It cannot renew fitness. It cannot hold a permit. It cannot legally earn.
The rule the Court was enforcing
The underlying obligation is Rule 125H of the Central Motor Vehicles Rules, inserted in 2016 via notification G.S.R. 1095(E), which requires public service vehicles to carry a tracking device and one or more emergency buttons. The device must conform to AIS-140 — the Automotive Industry Standard titled Intelligent Transportation Systems (ITS) — Requirements for Public Transport Vehicle Operation.
An AIS-140 VLTD is not a generic GPS box. The standard requires it to:
- Track position using GPS and NavIC, India’s own satellite constellation, and transmit at defined intervals to certified backend servers.
- Carry one or more physical, hard-wired panic buttons that send an immediate alert with the vehicle’s location to designated monitoring centres.
- Integrate with VAHAN and the National Vehicle Location Tracking backend.
Scope widened over time. G.S.R. 979(E) (28 September 2018) extended AIS-140 fitment to new commercial vehicles at registration. For hazardous goods, G.S.R. 617(E) (August 2022) mandated AIS-140 tracking on N2 and N3 category vehicles carrying gases and hazardous materials — new models from 1 September 2022, existing models from 1 January 2023.
The RFID half: FASTag
Running alongside the tracking mandate is India’s RFID tolling layer. FASTag — a passive UHF RFID windshield tag linked to the vehicle registration and a prepaid account — was made compulsory for all M and N category vehicles, including those sold before December 2017. The deadline was notified for 1 January 2021 and then extended to 15 February 2021. Vehicles using a FASTag lane without a working tag are charged double toll. From April 2021, the FASTag ID also had to be captured in Form 51 for third-party insurance.
The result is that a commercial haulage vehicle on national highways today needs both: an AIS-140 VLTD for its permit, and an active FASTag for its tolling.

Where barrier-free tolling actually stands
This is where a lot of industry commentary has gone stale, so it is worth being precise.
In 2024, MoRTH and IHMCL published concept papers and global expressions of interest for GNSS-based tolling, in which a compliant AIS-140 VLTD would act as the On-Board Unit (OBU), mapped to the vehicle’s FASTag under a “one vehicle – one OBU” policy, with distance-based fees settled over NETC/FASTag rails. Those documents are real, and they are the source of most “VLTD becomes your toll device” coverage still circulating.
What followed is different. Rather than a satellite-first rollout, the near-term path has been Multi-Lane Free Flow (MLFF) tolling built on ANPR cameras plus the existing FASTag RFID estate, with AI-assisted enforcement. Barrier-free lanes have gone live at plazas including Choryasi (Surat), Mundka (Delhi), Gharaunda (Haryana), and Manoharpura and Daulatpura (Rajasthan). A FASTag Annual Pass (₹3,000, valid for one year or 200 trips) launched on 15 August 2025 and had crossed roughly 77 lakh users by mid-2026 — though note that it covers private cars, jeeps and vans only, not commercial vehicles.
Reporting on GNSS timelines remains genuinely inconsistent: ministerial statements have pointed to full operation by end-2026, while other official positions have described nationwide satellite tolling as not yet approved. What is not in dispute is that FASTag RFID is the settlement layer either way — GNSS proposals route payment through NETC/FASTag rails, and the MLFF lanes read FASTag directly. Fleets planning capex should treat RFID as the constant and GNSS as the variable.
What this means for fleet and logistics operators
- Treat VLTD as a permit dependency, not an IT project. After the May 2026 order, the binding date is your next fitness or permit renewal.
- Verify VAHAN reflection, not just installation. The Court tied the consequence to the database record. Ask your vendor for proof of VAHAN integration, not a fitment invoice.
- Check your retrofit exposure. Any PSV registered up to 31 December 2018 is explicitly in scope.
- Confirm the device is genuinely AIS-140 certified, with NavIC support and a hard-wired panic button — not a consumer GPS tracker.
- Keep FASTag accounts funded and tags readable. In an MLFF lane there is no barrier to stop at and no cash fallback; a failed read becomes a penalty or a recovery notice rather than a delay.
- Plan for data, not just compliance. Mandated telemetry is a byproduct worth using — route optimisation, driver behaviour, cold-chain monitoring and yard turnaround all run on the same feed.

One is a tracking device; the other is an identity tag.
Does GNSS tolling replace FASTag?
Not in the near term. The GNSS concept papers published by MoRTH and IHMCL in 2024 propose distance-based tolling using an AIS-140 VLTD as the On-Board Unit, but they settle payment over the existing NETC/FASTag rails rather than removing FASTag. Meanwhile the barrier-free lanes actually operating today use ANPR cameras together with FASTag RFID reads. FASTag remains the settlement layer under both approaches.
Which vehicles must be retrofitted with a VLTD?
The Supreme Court’s order of 13 May 2026 in S. Rajaseekaran v. Union of India directs, at para 16.3, that all States and Union Territories ensure retrofitting of VLTDs and panic buttons in public service vehicles registered up to 31 December 2018. This makes clear the mandate is not limited to newly registered vehicles, and older fleet vehicles carry an active retrofit obligation.
What happens if a vehicle uses a toll lane without a working FASTag?
Under the National Highways Fee Rules, a vehicle entering a FASTag lane without a valid, funded and readable tag is liable to pay double the applicable toll. In a Multi-Lane Free Flow lane there is no barrier and no cash counter, so a failed read is typically handled as a penalty or recovery notice afterwards rather than as a stop at the plaza.
